Now that the UK has left the EU, the UK has an opportunity to decide its future regime for the exhaustion of intellectual property rights. This decision is vitally important for the UK as it will govern future rules on parallel imports into the UK.

There is currently an ongoing Intellectual Property Office consultation on what the UK’s new ‘exhaustion of rights’ regime will be following our departure from the European Union. The government are seeking views from businesses and individuals who may buy, sell or move IP-protected goods into the UK which have already been placed on the market in another territory outside the UK.

The question the consultation asks of businesses and individuals is if that if they buy, sell or move parallel goods into the UK from another territory, what regime would they like to see the UK implement for the future.
